The E-1 Treaty Trader Visa is for treaty traders – treaty trader meaning an individual must be a national of a country which possess a trading treaty with the USA. The E-1 visa is for traders who which to earn 50% of their revenues in their native country. An E-2 Treaty Investor visa is issues to those investors wishing to purchase an existing business in the United States or creating a new business in the United States. (Startups are permissible and so is property investments). Generally these two visas require an investment of $150,000-$200,000 as opposed to an investment of $500,000 along with a solid business plan.

It is important to understand that the E-2 visa differs from the EB-5 visa in that while it offers residency in the US, it is not typically a pathway to permanent residency as is the EB-5 visa. The E-2 visa, where a resident of another country commits to investing or purchasing a US business a way to remain in the US at a more manageable cost.

The E-2 visa needs to be renewed every two years but there is no maximum amount of times that it can be renewed. The E-2 visa holder can be accompanied by a spouse and their children up to age 21. The-E-2 visa applicant must show that the business they are investing in not a marginal venture. A solid business plan is a good way to demonstrate viability.
